The FAD unit is not plenum-rated because it is not installed in the plenum. It is designed to bring fresh outdoor air into the return duct of the furnace or air handler.

Answer:
The FAV system consists of a damper and a controller. The actual CFM is determined by the furnace or air handler that the FAV system is electrically interlocked with.
